ACLU against effort to allow Trump travel ban

According to CNN, the Trump administration appealed the case to the Supreme Court Thursday night, asking the nine justices to weigh the legality of Trump's order.

The Justice Department argued that the lower courts were wrong were therefore wrong to apply the enforcement ban nationwide.

At least five votes are needed on the nine-justice court in order to get the go ahead.

"Regardless of whether a stay is granted, the government respectfully requests expedited briefing and consideration of its petition for a writ of certiorari", the Trump team stated on the matter, Thursday, Washington Examiner reported.

Statements made during the campaign, the court said, make it clear the executive order stems from "President Trump's desire to exclude Muslims from the United States".

At issue is a ban Trump has said is necessary to protect Americans from terrorist attacks.

NPR reports that Hawaii's 9th circuit court has heard arguments by the administration to lift the appeal, but it has not ruled, while Maryland's 4th circuit's ruling was upheld.

The court majority savaged Trump's directive, saying it "drips with religious intolerance, animus and discrimination". So there's little upside to waiting for a ruling in hopes that it might be favorable and legally strengthen the administration's hand before the Supreme Court. In blocking Trump's travel ban, the appeals court pointed to that language and said the administration acted in "bad faith".
